PRONUNCIAMIENTO DE LA FEDERACIÓN  INTERAMERICANA DE ABOGADOS
SOBRE EL RESPETO A LOS PODERES DEL ESTADO, A LA EXPRESIÓN LEGÍTIMA
DE LA VOLUNTAD POPULAR Y AL ORDEN PÚBLICO.

La Federación Interamericana de Abogados – FIA tiene como misión promover el Estado de derecho y el respeto a los principios democráticos y a los derechos humanos. Como gremio que reúne a abogados del hemisferio occidental, de España, Inglaterra y Francia, con más de ochenta años de existencia en la vida político-jurídica de las Américas, es un referente para los Estados como sujetos del derecho internacional.

Las democracias constitucionales se basan en la separación de poderes, creando un sistema de contrapesos efectivos para asegurar el imperio de la ley, la protección de los derechos y libertades individuales y que prevalezca el orden público. Las democracias representativas se cimientan en el respeto a la expresión legítima de la voluntad popular mediante elecciones realizadas de acuerdo con la Constitución y la ley.

Ante los lamentables acontecimientos ocurridos el domingo 8 de enero del presente en Brasil, como son los ataques a las instalaciones de gobierno de los tres poderes del Estado, la FIA expresa su más enérgico rechazo ante todo acto de violencia política y todo intento de desestabilizar la democracia y subvertir el orden. Asimismo, reitera su compromiso con la defensa de las instituciones democráticas y el Estado de derecho, e insta al respeto a las autoridades democráticamente elegidas recientemente por la ciudadanía.

La FIA defiende el ejercicio de la libertad de expresión y la participación en la vida política en forma pacífica y basada en el respeto a la Constitución, la ley y los derechos de las demás personas. El ejercicio de dicho derecho no es irrestricto y no ampara actos de violencia política o incitar a ella, ni atentados contra las instituciones públicas y los poderes del Estado, ni contra la integridad física de las personas. Esos actos deben ser rechazados y sancionados.

DECLARATION OF THE INTER-AMERICAN BAR ASSOCIATION
CONCERNING RESPECT FOR THE BRANCHES OF GOVERNMENT, THE LEGITIMATE EXPRESSION
OF THE WILL OF THE PEOPLE, AND THE PUBLIC ORDER.

The Inter-American Bar Association – IABA – has as its purpose the promotion of the rule of law and respect for democratic principles and human rights.  As an association of the lawyers of the Western Hemisphere, of Spain, the United Kingdom, and France, having an organizational history of 80 years in the political and juridical life of the Americas, the IABA is a is an authoritative point of reference for the said States concerning matters of international law.

Constitutional democracies are based on the division of power among the different branches of government and an effective system of checks and balances to protect individual rights and freedoms and ensure that public order and the Rule of Law prevail. Representative democracies are solidly based on respect for the legitimate expression of the popular will, by means of elections which are conducted in accordance with the requirements of the Constitution and of the law.

In view of the unfortunate events that took place on Sunday, January 8, 2023, in Brazil, the attacks on the buildings of the three branches of government, the IABA expresses its strongest rejection of any act of political violence and any attempt to destabilize democracy and subvert the public order. It also reiterates its commitment to the defense of democratic institutions and the Rule of Law and urges respect for the authorities who were recently democratically elected by the people.

The IABA defends the exercise of the freedom of expression and political participation in a peaceful manner and with respect for the Constitution, the law, and the rights of others. The exercise of this right is not unrestricted and does not cover acts of political violence or incitement to it, nor attacks against public institutions and the branches of government, nor against the physical integrity of persons. Such acts must be rejected and sanctioned.
