PRONUNCIAMIENTO DE LA Federación INTERAMERICANA DE ABOGADOS
EN DEFENSA DE LAS LIBERTADES INDIVIDUALES DEL PUEBLO CUBANO
La Federación Interamericana de Abogados – FIA tiene como misión promover el Estado de derecho y el respeto a los derechos humanos. Como gremio que reúne a los abogados del continente, de España, Inglaterra y Francia, con ochenta años de existencia en la vida político-jurídica de las Américas, es un referente para los Estados como sujetos del derecho internacional.
En línea con su misión institucional de promover el Estado de derecho y la defensa de los derechos y libertades de la persona humana, la FIA tiene el compromiso de promover el respeto a los principios democráticos y el derecho a la libertad de expresión de las personas.
Las democracias constitucionales se basan en la separación de poderes y el ejercicio balanceado del poder, creando sistemas de pesos y contrapesos efectivos para asegurar el imperio de la ley y prevenir el ejercicio abusivo del poder. Estos principios de división de poderes y de balance en su ejercicio propugnados originalmente por Locke y Montesquieu, han evolucionado e inspirado constituciones a través de la historia por su valor en prevenir el ejercicio abusivo del poder y por su valor en la formación de sociedades más justas e igualitarias que aseguren la debida protección de los derechos de las personas y el ejercicio de las libertades individuales.
La FIA respeta la soberanía de los Estados y, al mismo tiempo, promueve el respeto al Estado de derecho. Entre los pilares del Estado de derecho están el respeto y la protección de los derechos humanos, el acceso a la justicia y a remedios efectivos.
El pueblo cubano ha vivido más de 60 años bajo un modelo autoritario. Los recientes sucesos en Cuba, que muestran la desesperación de su pueblo, así como las limitaciones a la libertad de expresión y otras libertades individuales, causan consternación en la comunidad internacional comprometida con los valores y principios democráticos.
En concordancia con nuestra misión de promover el Estado de derecho y los valores democráticos, así como promover el respeto a las libertades individuales, la FIA invoca al Estado cubano a respetar las libertades ciudadanas y adherirse a los principios y valores democráticos. Asimismo, exhorta a la comunidad internacional a apoyar al pueblo cubano y a requerir a su administración que se adhiera a dichos principios y respete los derechos humanos de su población. El hecho de haber vivido más de seis décadas bajo un sistema autoritario no significa que esta situación se tenga que perennizar y que sus dirigentes no puedan optar por una decisión histórica de promover la transición a un modelo democrático y representativo de la voluntad de su pueblo.
La FIA expresa su solidaridad con el pueblo cubano por lo vivido en el contexto de la actual pandemia y la crisis económica y sociopolítica que afecta a su país. Igualmente, se identifica con su lucha pacífica por mejores condiciones de vida y libertad. Asimismo, se compromete a hacer seguimiento a los acontecimientos que se están suscitando en su país, en defensa de los derechos de la población cubana ante la comunidad internacional.
El proyecto democrático supone un compromiso y trabajo constante tanto por parte de los gobernantes y los gobernados, actuaciones responsables y legítimas de ambos, así como el trato justo e igualitario ante la ley. La FIA insta a seguir trabajando por sociedades más igualitarias, justas y pacificas en las Américas y en el mundo entero. ¡Es tarea de todos!

DECLARATION OF THE INTER-AMERICAN BAR ASSOCIATION
IN DEFENSE OF THE INDIVIDUAL LIBERTIES OF THE CUBAN PEOPLE
The Inter-American Bar Association – IABA – has as its purpose the promotion of the rule of law and respect for human rights. As an association of the lawyers of the Western Hemisphere, of Spain, the United Kingdom, and France, having an organizational history of 80 years in the political/juridical life of the Americas, the IABA is a is an authoritative point of reference for the said States concerning matters of international law.
In accordance with our institutional mission to promote the Rule of Law and to defend the rights and freedoms of human beings, the IABA is committed to promote respect for democratic principles and fundamental individual liberties including the freedom of expression.
Constitutional democracies are based on the division of power among the different branches of government and an effective system of checks and balances the purpose of which is to protect the Rule of Law and to prevent the abuse of power. These principles of division of powers and checks and balances in their exercise, originally advocated by Locke and Montesquieu have evolved and inspired constitutions throughout history for their value in preventing the abuse of power and establishing fairer and more equal societies that ensure an effective protection of people’s rights and the exercise of their individual freedoms.
The IABA respects the sovereignty of States while promoting respect for the Rule of Law. Among the pillars of the Rule of Law are to respect and protect human rights, access to justice and to effective remedies.
The Cuban people have endured over 60 years under an authoritarian system. Recent events in Cuba, that show the desperation of its people and the limitations to their freedom of expression, have caused consternation among members of the international community.
In line with our mission to promote the Rule of Law and democratic values, and to promote respect to individual liberties, the IABA exhorts the Cuban government to respect the individual liberties of its people and to adhere to democratic principles and values. The IABA also calls for the international community to support the Cuban people and to call upon their government to adhere to said principles and to respect the human rights of its people. The fact that they have lived over six decades under an authoritarian regime, does not mean that this situation must be perpetual, since its government could make an historic decision to promote the transition to a democratic system that effectively represents the will of its people.
The IABA expresses its solidarity with the people of Cuba who have been seriously affected by the current pandemic and the economic and sociopolitical crisis that they are experiencing. The IABA also expresses its solidarity with their peaceful protests for better living conditions and freedom. It also commits itself to follow up on current events in Cuba, to defend the rights of its people before the international community.
The democratic project requires a commitment and constant effort on the part of both those who govern and those who are governed, responsible actions of both, as well as fair and equal treatment under the law. The IABA calls upon the continuing commitment of everyone to achieve societies that are more equal, fair, and peaceful in the Americas and in the entire world. It is everyone’s duty!
